Briefing Overview

From January 2027, the qualifying period for ordinary unfair dismissal is set to reduce from 2 years to 6 months. This change significantly alters the point at which employees gain protection and increases the need for employers to make well-evidenced decisions much earlier in the employment relationship. 

This session will cover: 

  • The legislative changes to the unfair dismissal qualifying service  
  • How these changes shift the risk profile for schools  

We will also explore the practical implications, including: 

  • Increased exposure to claims where concerns are not addressed within the first 6 months  
  • The need for robust recruitment, onboarding, and probationary frameworks
