A new law “The Worker Protection (Amendment of Equality Act 2010) Act 2023” comes into force on 26 October 2024 and places a statutory duty on employers to take “reasonable steps” to prevent sexual harassment of their employees in the workplace.
If an employer fails to take such steps, the Equality and Human Rights Commission (EHRC) can take enforcement steps and any compensation awarded from a successful tribunal claim can be uplifted by up to 25%.
The new duty will sit alongside employees’ existing protections from sexual harassment in the Equality Act.
